Child Custody / Time Sharing

The care and upbringing of children during the divorce process and thereafter is often an ongoing source of conflict for divorcing parents.

In 2008 the laws pertaining to child custody changed. The new law no longer uses the term "child custody" and instead requires all divorcing couples who have minor children to adopt a "parenting plan" which is in the child's best interest with the intent that the child have frequent and continued contact with both parents after the divorce.

In some untraditional situations a parent may have certain issues that would place the child at risk, so that frequent and continued contact poses a substantial likelihood that being with that parent could be detrimental to the child's best interests. In these difficult cases, Yaffa & Associates will work toward educating the court as to why certain restrictions should be in place until as safe and healthy environment is in place.
